The Federal High Court in Abuja has dismissed a bail plea submitted by Abba Kyari, a detained deputy commissioner of police, to be released from the National Drug Law Enforcement Agency’s custody (NDLEA).
The federal government was sued by the suspended ‘super cop’ in court, disputing his continuing imprisonment by the NDLEA.
In the suit filed on FHC/ABJ/CS/182/22, Kyari sought an order from the court to release him immediately or, in the alternative, to admit him to bail with liberal conditions.
Kyari claimed in an ex-parte application presented by his lawyer, Cynthia Obianuju Ikena, that he has severe diabetes that is threatening his life and that he needs immediate medical attention.
In a brief judgement on Monday, Justice Ekwo declined to order his immediate release but did order him to notify the respondent.
The judge ordered him to travel to the Federal Government and serve all of the proceedings he had filed.
All of the averments and charges leveled against the Federal Administration are so serious, according to Justice Ekwo, that the court must allow the government to respond before taking any action.
He then set a date for the parties to appear before him on February 24.
Kyari was accused and imprisoned by the NDLEA of being a member of a drug network that works along the Brazil-Ethiopia-Nigeria route, distributing lethal narcotics such as cocaine.
