The petition of the Action Alliance against the President-elect, Asiwaju Bola Ahmed Tinubu has been dismissed by the Presidential Election Petition Tribunal on Monday.
The tribunal said for want of any objection to the request for the withdrawal of the petition, the petition stands dismissed.
Oba Maduabuchi, a senior advocate of Nigeria (SAN), who led the legal team of the party said he filed the petition on behalf of the 1st and 2nd petitioners.
The party announced its withdrawal at the commencement of the pre-hearing of the Presidential Election Petition Tribunal on Monday in Abuja.
Subsequently, Maduabuchi formally applied to withdraw the petition of the party.
Prior to the announcement of the withdrawal, another lawyer had announced himself as the representative of the AA.
Justice Haruna Tsammani subsequently struck out the petition after the respondents – the All Progressives Congress (APC), the President-Elect and the Independent National Electoral Commission (INEC), said they had no objection.
Peter Obi of the Labour Party and Atiku Abubakar of the Peoples Democratic Party are also challenging Tinubu’s victory.
A major plank of their dispute is the failure of the Independent National Electoral Commission to upload the result on its website portal in real-time as promised.
However, the National Electoral Commission has argued that the final result reflected the will of the electorate and delays in uploading the results were caused by technical glitches and a spike in traffic. INEC said the glitches did not alter the result of the election.
